Are HOAs required to inspect their stormwater ponds?

Yes. Almost every metro Atlanta jurisdiction requires HOAs to perform an annual inspection of post-construction stormwater facilities — detention ponds, retention ponds, bioretention areas, underground systems and outfalls — and submit the report to the local MS4 authority.

What happens if our HOA misses a stormwater inspection?

Most counties issue a notice of violation, then escalating fines that can reach $1,000 per day until the inspection is filed. Some jurisdictions can place a lien on the HOA's common area. We can usually clear an NOV within 5 business days.

Who is responsible — the HOA or individual homeowners?

The HOA. Post-construction stormwater facilities sit on common-area property and are the HOA's legal responsibility under the recorded maintenance agreement filed with the county.
