Any commercial property in metro Atlanta with a post-construction stormwater facility — detention pond, bioretention, underground vault, sand filter, or other BMP — requires at least an annual inspection. Active construction sites disturbing 1+ acre need weekly NPDES inspections.

Are stormwater inspections required for retail, office and industrial sites?

Yes. Retail centers, office parks, industrial facilities, hotels, restaurants, self-storage and apartments all require annual stormwater facility inspections under their county MS4 program.

Who is liable if our commercial property fails an inspection?

The property owner, per the recorded stormwater maintenance agreement filed with the county. Tenants are generally not responsible unless the lease explicitly assigns it. Notice-of-violation fines can reach $1,000 per day.
